Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyTradeNest, a platform that lets vendors in Ghana create online shops to sell products, and service providers list bookable services, and lets customers discover and order from them. By creating an account, listing a product or service, placing an order, or otherwise using MyTradeNest, you agree to these Terms.

1. What MyTradeNest Is

MyTradeNest is a marketplace and storefront platform. We provide the technology - shop pages, product and service listings, order and inventory management, a point-of-sale tool, sales and profitability reports, and payment/checkout tooling - but each shop is independently owned and operated by its vendor or service provider. MyTradeNest is not the seller of record for products or services listed by vendors, and we are not a party to the contract of sale between a vendor and a customer unless we expressly say otherwise.

2. Accounts

Vendor and service provider accounts

To create a shop or list services you must be at least 18 years old and provide accurate information (name, business name, email, and where relevant a referral code). You are responsible for keeping your login credentials secure and for all activity that happens under your account.

Staff accounts

A vendor may invite staff members to help manage their shop (for example, to use the point-of-sale system or fulfill orders). The vendor is responsible for the actions of staff they invite and for removing staff access when appropriate.

Customers

Customers can browse and order from a shop without creating a MyTradeNest account. Placing an order requires providing your name, contact details, and delivery address so the vendor can fulfill it.

3. Subscription Plans

MyTradeNest offers tiered vendor plans (currently Hustle, Nest, Market, and Empire) with different feature sets, such as advanced reporting, point-of-sale access, and staff accounts. Hustle is free; paid plans are billed on a recurring basis through our payment processor, Paystack. By subscribing to a paid plan you authorize us to charge the applicable fees to your chosen payment method. You can upgrade, downgrade, or cancel a subscription at any time from your dashboard; changes take effect according to the billing terms shown at the time. Except where required by Ghanaian law, subscription fees already charged are non-refundable.

4. Vendor and Service Provider Responsibilities

If you list products or services on MyTradeNest, you agree that:

  • You have the legal right to sell the products or offer the services you list, and your listings, prices, and stock levels are accurate
  • You will fulfill confirmed orders and bookings in good time, and update order status honestly (stock is only deducted, and a sale is only counted, once you mark an order as shipped, delivered, or completed)
  • You are responsible for the quality, safety, and legality of what you sell, and for complying with applicable Ghanaian consumer protection, product safety, and tax laws
  • You will not list counterfeit, stolen, illegal, or prohibited goods or services
  • Cost prices, profit figures, and other business data you enter are yours - we do not share them with customers or other vendors

5. Orders, Payments & Delivery

Orders placed through a shop are sent to that vendor as pending until the vendor confirms them. Payment may be made online (processed securely by Paystack) or by other methods the vendor supports, such as Mobile Money or cash on delivery. MyTradeNest does not guarantee delivery timelines, product quality, or refunds - these are the vendor's responsibility, though we may assist in resolving disputes where we reasonably can. We do not store your full card details; online payments are handled directly by Paystack.

6. Referral Program

We may offer a referral program that lets marketers share a referral code or link with prospective vendors. Any commission, reward, or eligibility terms for the referral program will be described separately when you join it, and we may change or discontinue the program at any time.

7. Prohibited Uses

You agree not to:

  • Use the platform for fraud, money laundering, or any unlawful purpose
  • Misrepresent your identity, business, or affiliation with MyTradeNest
  • Attempt to circumvent subscription tier limits, scrape data, or interfere with the platform's normal operation
  • Send spam, abusive messages, or misuse the WhatsApp/contact links generated by the platform
  • Upload content that infringes someone else's intellectual property or violates their rights

8. Content and Intellectual Property

You retain ownership of the product listings, images, shop branding, and other content you upload. By posting content, you grant MyTradeNest a non-exclusive license to host, display, and distribute it as needed to operate the platform (for example, on your public shop page). The MyTradeNest name, logo, and platform software are our property and may not be used without permission.

9. Communications

We will send you emails related to your account, orders, and subscription (such as sign-up confirmation codes, order notifications, and receipts). These are considered part of the service and cannot be opted out of while you hold an account; you can unsubscribe from optional marketing emails at any time.

10. Suspension and Termination

We may suspend or terminate access to a shop or account that violates these Terms, engages in fraudulent or unlawful activity, or poses a risk to other users of the platform. You may close your account at any time; some order and financial records may be retained afterward as described in our Privacy Policy or as required by law.

11. Disclaimer of Warranties

The platform is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or completely secure, and we make no warranties about the products or services listed by vendors, who act independently.

12. Limitation of Liability

To the maximum extent permitted by Ghanaian law, MyTradeNest will not be liable for indirect, incidental, or consequential damages, or for losses arising from transactions between vendors and customers, including disputes over product quality, delivery, or payment.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms here with a new "Last updated" date. Continuing to use MyTradeNest after changes take effect means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Ghana, and any disputes will be subject to the exclusive jurisdiction of the courts of Ghana.
